In each verdict listed below, each defendant was represented by an insurance company's lawyer. Every time a case is tried in our courts on our type of cases, the defendant is represented by an insurance company lawyer. An insurance company was involved in all of the cases listed below and they either paid all or a portion of the results listed below. However, the fact that a defendant has insurance is not allowed to be disclosed to the jury during the course of a trial. The jury is "kept in the dark", so to speak, on this issue. Also, in EVERY personal injury case listed below, the insurance company's tactics are to DENY all fault for the wreck and injuries, DENY all reasonable attempts by our clients to settle the case for a reasonable amount with the defendant's insurance company, and force the case to be tried by a jury. Usually the day or week before the trial, the defendant's insurance carrier will suddenly admit fault, and then argue to the jury they are there to "accept responsibility" and "not give the plaintiff a blank check". Many insurance companies have tried these same tricks over and over on our clients. Many times, it has cost them mightily, as the jury sees through the insurance company tactics, and the truth is exposed. See below.

  • $76,792 Jury Verdict for Car Wreck with soft tissue injuries. Prior to trial, the plaintiff had offered to settle for $18,000. Allstate Insurance offered $17,000 to settle the case as their "final offer". Over a $1000 difference, this case proceeded to trial. The Dickson County jury returned a verdict for $76,792.00 Allstate appealed, claiming that the result was too high for a soft tissue injury. The Court of Appeals found the verdict was fair, and affirmed the jury's verdict. Allstate had risked their own insured's assets, as their defendant/insured had only $25,000 in coverage. The verdict exposed their insured's personal assets to possible loss. Faced with a potential bad faith claim for failure to offer to settle for a reasonable amount prior to trial, Allstate had to pay the entire award, plus interest, along with costs, for a total of $87,635.17 Steward v. Smith, Case No. M2009-00048-R3-CV, Dickson County
